These Terms & Conditions apply when you use www.lumsyorganic.co.uk or buy products from Lumsy Limited. Please read them before placing an order. By placing an order, you confirm that you accept these terms.

1. About us

The website and products are operated and sold by Lumsy Limited, registered in England and Wales under company number 16594068, with registered office at 91 Walm Lane, London, NW2 4QG, United Kingdom. Contact: info@lumsyorganic.co.uk.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to place an order. Products are intended to be purchased and served by a responsible adult.

3. Product information

We take reasonable care to describe and display products accurately. Packaging, colour, texture and appearance may vary slightly, including because ingredients are agricultural products and recipes may be produced in batches. Images are illustrative and screen settings can affect colour.

Always read the product label before serving. The label supplied with the product takes priority if website information differs. Contact us before use if you are uncertain about any ingredient, allergen, storage or serving information.

4. Allergens, nutrition and feeding

Ingredients, allergens, nutrition, suitable age, storage and serving instructions are provided on the product page and label. Our products are not a substitute for professional medical advice. Introduce foods in line with appropriate health guidance and seek advice from a qualified healthcare professional if a child has an allergy, medical condition, feeding difficulty or special dietary requirement.

5. Orders and contract formation

• Your order is an offer to buy the products in your basket.

• An automated acknowledgement confirms receipt of the order but does not necessarily mean we have accepted it.

• A contract is formed when we send an acceptance or dispatch confirmation, or otherwise dispatch the products.

• We may refuse or cancel an order before acceptance, including because a product is unavailable, a price or description contains an obvious error, payment is not authorised, delivery is unavailable, or we reasonably suspect fraud or misuse. If payment has been taken, we will refund it.

6. Prices, payment and promotions

Prices and delivery charges are shown in pounds sterling and include applicable taxes unless stated otherwise. The total payable is shown before order confirmation. Payment must be made using an available method at checkout and may be handled by a third-party payment provider.

Promotional offers and codes are subject to their stated conditions, availability and expiry. Unless stated otherwise, offers cannot be combined, exchanged for cash or applied retrospectively. We may withdraw an offer where permitted, but this will not affect an order already accepted.

7. Availability and substitutions

Products are subject to availability. We will not substitute a product without your agreement where the substitution would materially change the order, ingredients, allergens or price. If we cannot supply a product, we may cancel that item and refund the amount paid for it.

8. Delivery

Delivery availability, charges and estimates are shown during checkout and explained in our Delivery Policy. You must provide accurate delivery details and follow storage instructions promptly after receipt. Delivery dates are estimates unless expressly guaranteed.

9. Cancellations, returns and refunds

Your cancellation, return, replacement and refund rights are explained in our Returns & Refunds Policy. Food that is liable to deteriorate or expire rapidly is excluded from the statutory change-of-mind cancellation right. Sealed goods unsuitable for return for health-protection or hygiene reasons also lose the cancellation right once unsealed. These exceptions do not affect your rights where goods are defective, unsafe, not as described or otherwise fail to conform to contract.

10. Accounts and website use

If account functionality is available, you are responsible for keeping login information confidential and for activity under your account. Tell us promptly if you suspect unauthorised access.

You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with operation, scrape content unlawfully, commit fraud, or use the website in breach of law or another person’s rights.

11. Intellectual property

The Lumsy name, logos, website design, text, photographs, graphics and other content are owned by or licensed to Lumsy Limited and protected by intellectual-property laws. You may use the website for personal, non-commercial shopping. No content may be copied, modified, distributed or commercially exploited without written permission, except as permitted by law.

12. Our responsibility

We do not exclude or limit liability where it would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

Subject to the paragraph above, we are responsible for losses that are a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable, business losses arising from a consumer purchase, or failure caused by information or instructions you supplied, except where the law says otherwise.

13. Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control. We will take reasonable steps to reduce the effect, communicate material delays and perform our obligations as soon as reasonably possible. Your statutory rights remain unaffected.

14. Personal information and cookies

We handle personal information as described in our Privacy Policy and use cookies and similar technologies as described in our Cookie Policy and cookie settings.

15. Changes to these terms

We may update these terms to reflect changes in law, products, services or business practices. The terms in force when your order is accepted will apply to that order, unless a change is required by law or agreed with you.

16. If part of these terms is invalid

If a court or relevant authority decides that any provision is unlawful or unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right does not waive that right.

17. Third-party rights

Only you and Lumsy Limited have rights under the contract, except where the law provides otherwise. No other person may enforce these terms under the Contracts (Rights of Third Parties) Act 1999.

18. Governing law and courts

These terms and any dispute are governed by English law. If you live in England or Wales, the courts of England and Wales have non-exclusive jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts. Any mandatory consumer protections that apply where you live remain unaffected.
